No. Determining what factually happened has no bearing here. This is all about: even if everything Pat says is true, has he still made a legal claim? If yes, then go to trial. This is about whether there's an actual claim based on law.

Determining "reasonableness" is a question of fact to be determined by the finder of facts (in this case a jury).
